There Are Reasons for Wait Times

If you or your loved one has experienced wait times you felt were detrimental to the outcome of the situation, determining who is liable is essential in every case. As frustrating and scary as it may seem, there are several factors that can contribute to ER delays. A few common issues include:

Liability

The hospital maintains certain responsibilities, and enjoys certain protections under the federal Emergency Medical Treatment and Active Labor Act (EMTALA), pursuant to Florida Statute Chapter 395 HOSPITAL LICENSING AND REGULATION and pursuant to Florida Statute Chapter 766. About Best Lawyers

Best Lawyers is the oldest and most respected lawyer ranking service in the world. For 40 years, Best Lawyers has assisted those in need of legal services to identify the lawyers best qualified to represent them in distant jurisdictions or unfamiliar specialties. Best Lawyers awards are published in leading local, regional and national publications across the globe.

Lawyers who are nominated for consideration are voted on by currently recognized Best Lawyers working in the same practice area and located in the same geographic region. Maney Gordon Trial Lawyers Stay In Step Charity Give 2022

It's this same kind of commitment and value system we share with STAY IN STEP (SIS), a veteran-founded and -operated Spinal Cord Injury Recovery Center. It is a personal importance to the team at MANEY | GORDON Trial Lawyers that we support local organizations so we can work together to make our communities stronger.

By supporting SIS, we aim to foster a sense of unity and inspire others to join us in creating a stronger, more compassionate community. We firmly believe that giving back is not only a responsibility but also a privilege, and we are honored to be able to make a tangible fiscal impact.

Built on the Back of a Soldier

While conducting a combat operation in Afghanistan on Sept. 16, 2008, Chief Warrant Officer Romulo “Romy” Camargo sustained a gunshot wound that paralyzed him from the neck down. The surgeries and rehabilitation that followed the next seven years laid the groundwork for the STAY IN STEP (SIS), a veteran-founded and -operated Spinal Cord Injury Recovery Center co-created by Romy and his wife Gaby. SIS is not only a neighboring association in Tampa Bay, FL, it is a highly sought after incomparable rehabilitation center that provides innovative and cutting-edge therapies to help those with spinal cord injuries achieve greater mobility, independence, and a better quality of life. SIS offers a range of services, including physical therapy, occupational therapy, speech therapy, and counseling, all tailored to meet the specific needs of each individual on their road to recovery.

Romy in Action

According to a 2016 report by the National Spinal Cord Injury Statistical Center, approximately 30% of persons with spinal cord injuries are re-hospitalized one or more times during any given year following injury. Among those re-hospitalized, the length of hospital stays averages 22 days. The STAY IN STEP program focuses on preventing and in many cases, reversing the deterioration that results from lack of sustained physical activity. This not only results in a better quality of life for clients but reduces the emotional and financial burden on families and caregivers.

Jeffrey "Jack" Gordon spearheads the relationship between MANEY | GORDON Trial Lawyers and SIS. He told his constituents, “We're honored to support an organization like STAY IN STEP. The brave people who defend our country are a special breed. We are grateful to be in a position to be able to help them grow their outreach."

SIS provides long-term rehabilitation and therapy to both veterans and civilians suffering from spinal cord injuries, traumatic brain injury or any other neurological disorder resulting in paralysis. SIS is able to do this with the same principles and dedication as MANEY | GORDON Trial Lawyers: true advocacy.

What sets STAY IN STEP apart is their commitment to advancing rehabilitation therapies and participating in innovative, groundbreaking research. The center continuously explores and adopts cutting-edge technologies, including robotics and exoskeletons, to enhance recovery outcomes.

The History of Florida Trend and the Legal Elite

Florida Trend, a monthly business magazine established in 1958, has been a driving force in the Sunshine State's business landscape for over six decades. It’s why 270,000 businesses, government and civic leaders rely on it for the latest news. That's more than the entire population of St. Petersburg. The magazine covers everything from regional economic development and industry news to profiles of successful entrepreneurs and innovators in the state. Recognizing the vital role that legal professionals play in the business community, Florida Trend introduced the Legal Elite awards in 2004. This annual recognition program honors the state's top lawyers, as voted by their peers, for their outstanding achievements and contributions to the legal profession.

The Legal Elite Hall of Fame

In 2009, Florida Trend introduced the Legal Elite Hall of Fame to honor a select group of attorneys who consistently rank among the top tier in the annual Legal Elite list. With a rigorous selection process that includes peer nominations, a panel review, and independent research, the Hall of Fame inductees represent the best of the best in Florida's legal community. Induction into the Hall of Fame is a testament to an attorney's dedication to excellence, professionalism, and commitment to the highest ethical standards in their practice. Jack Gordon now sits amongst those honored.

A car accident lawyer helps victims and their families recover losses caused by an automobile accident. They ensure that all applicable laws are followed and that all evidence is presented in the most effective way, so that you receive the full compensation you deserve.

When Should You Get a Lawyer for a Car Accident?

It’s important to get a lawyer involved as soon as possible. You should also be aware of any deadlines in your state for filing a lawsuit or making a claim. In Florida, the statute of limitations is two years, but this can vary based on details. Step 1: Start your search by finding attorneys with a track record of success and who have earned large settlements and verdicts for their clients. Before you hire a car accident attorney, you should do some research. Ask around for referrals from friends, family and colleagues who have used a car accident attorney in the past. You can also research online for reviews and ratings of local attorneys.

Step 2: Once you’ve narrowed down your list of potential attorneys, set up a meeting to discuss the details of your case. When you meet with an attorney, you should ask questions about their experience and qualifications. You should also ask about their trial strategies, fees and payment terms. Be on the lookout for clear and honest communication every step of the way.

What Is a Personal Injury?

What Is a Personal Injury?

If you’ve recently been involved in an accident or experienced an injury and are wondering if it qualifies as a personal injury, you’ve come to the right place. So, what is a personal injury? A personal injury is any type of injury to your mind, body, or emotions caused by someone else’s negligence or intentional misconduct. Being involved in a personal injury can be a devastating experience, and you may face many challenges, from physical pain and ongoing medical needs to lifestyle disruptions and emotional distress.

What Is Considered a Personal Injury?

A personal injury can include various types of injuries, from physical injuries, such as broken bones and head trauma, to emotional injuries, such as anxiety and depression. It can also include lost wages due to the necessary time off for medical treatments, as well as property damage. A personal injury can be the result of a car accident, a slip and fall accident, a medical malpractice incident, a defective product, or any other type of event where someone else’s negligence or intentional misconduct caused your injury.

What Is a Personal Injury Case?

A personal injury case is the legal process of pursuing compensation for the losses suffered by the injured party. This can include medical expenses, lost wages, pain and suffering, and property damage. To pursue a personal injury case, you must file a lawsuit in civil court against the party responsible for your injury. You will need to provide evidence to support your case, including medical records and witness statements, and your best shot for getting a settlement or verdict is to hire a team of exceptional personal injury lawyers to represent you.

Settlements vs. Verdicts

The difference between a personal injury settlement and a verdict is that a settlement is an agreement between both parties in which the plaintiff agrees to accept a certain amount of money from the defendant in exchange for dropping the case. A verdict is a decision made by a jury, where the jury finds the defendant liable for the plaintiff’s injuries and awards a certain amount of money in damages. Most defendants in personal injury cases hope to have the case dismissed or settle out of court for a reasonable sum of money. Be sure to hire a lawyer for injury cases who will fight for you - and one who isn't afraid to go to trial to get you the justice you deserve.

What Is Medical Malpractice?

When seeking medical treatment, you expect to receive competent and professional care. Unfortunately, medical errors happen, and when they do, they can have devastating consequences. At MANEY | GORDON Trial Lawyers, we have seen firsthand the physical, emotional, and financial toll that medical negligence can take on individuals and their families. But what is medical malpractice, and how do you know if you have a case?

what is medical malpractice - defined

Defining Medical Malpractice in Florida

Medical malpractice occurs when a healthcare provider fails to meet the accepted standard of care, resulting in harm to a patient. This can involve doctors, nurses, hospitals, or other medical professionals whose actions—or lack thereof—lead to injury, worsened conditions, or even death. These cases require proving that a provider’s negligence directly caused significant damage beyond what the patient would have experienced under competent care.

Some of the most common types of medical malpractice include:

How Do You Prove Medical Malpractice?

Unlike standard personal injury claims, medical malpractice cases require specific elements of proof. At MANEY | GORDON Trial Lawyers, we work with top medical experts to establish:

  1. A Doctor-Patient Relationship – Proof that the provider had a duty to treat you under accepted medical standards.
  2. A Breach of Duty – Evidence that the provider acted negligently or failed to provide appropriate care.
  3. Causation – Demonstrating that the breach directly led to your injuries.
  4. Damages – Establishing measurable losses such as medical expenses, lost wages, and pain and suffering.

What Is the Statute of Limitations in Florida for Medical Malpractice Cases?

If you believe you have been a victim of medical negligence, you must act quickly. Florida law generally allows victims two years from the date of discovery of malpractice to file a lawsuit. However, certain exceptions may apply, such as cases involving minors or fraudulent concealment of negligence. At MANEY | GORDON Trial Lawyers, we carefully assess the details of each case to determine the best legal strategy before the deadline expires.

One of the biggest concerns clients have is the cost of legal representation. At MANEY | GORDON Trial Lawyers, we handle medical malpractice cases on a contingency fee basis for payment, meaning you pay nothing unless we win your case. This ensures that every victim, regardless of financial situation, has access to experienced legal representation without any out-of-pocket expenses.
